THE FOLLOWING IS AN E MAIL I RECEIVED FROM THE CHIEF DETECTIVE OF CANADIAN INTERNAL AFFAIRS , IN RESPONSE FROM A REQUEST I MADE ON BEHALF OF THE FORUM!! REGARDING THE AMBIGUOUS INTELLIGENCE & INFORMATION PROCUREMENT METHODS BETWEEN US & OUR NORTHERN PALS!!*** ALL OF YOU CANADIAN READERS PLEASE TAKE NOTE!!**

Hello Mr. LXXIX

I appreciate you contacting Internal Affairs and your interest in perusing some of our website.

The frustration you and others attempting to conduct investigations in Canada is very real and widespread.

Basically, the forces of political correctness and privacy protection have hijacked the investigative process and information critical to the conduct of enquiries is simply not lawfully available, except to some limited extent, at great and unjustifiable cost. This is particularly so in Canada where virtually nothing of practical interest exists or is accessible in a public record.

In essence, apart from information that is already in the public domain, either through voluntary disclosure in advertising, on websites, in telephone directories or other media, virtually all information in government or corporate files is strictly confidential and can be obtained essentially in only two (lawful) ways: by Consent of the individual or entity to whom or with whom the record relates or is held or by means of a Court Order.

Of course, there is a third way of obtaining non-public information and that is through a confidential source or sources who have access to the sought after information, but obtaining information in this way is at the very least problematic and may involve the commission of criminal and other offences in Canada and elsewhere which, of course, creates legal risks for both the party who obtains and provides the information as well as those such as private investigators and their clients who may use or wish to disclose the information for the purpose of litigation or otherwise. In the absence of information provided by confidential sources, it is clear that, in theory and in fact, the ability of a private investigator to operate successfully and obtain positive results is severely limited.

In my humble opinion, privacy and related legislation has gone much too far and now virtually prevents individuals and corporations from conducting appropriate and necessary due diligence enquiries while at the same time frustrating both civil and criminal investigations alike with the result that the real beneficiaries of this type of myopic – and perhaps deliberately designed law – are criminals of all kinds, including corrupt politicians, embezzlers, money launderers, members of organized criminal enterprises, fraudsters, and thieves of all kinds, both of the corporate and personal variety, whether they be accountants who divert monies form their employers or spouses who divert matrimonial assets to hidden and/or off-shore accountants. Sophisticated criminals who obtain, divert and hide millions of dollars from their illicit activity have little fear of being caught particularly in our increasingly technological environment where dummy corporations and hidden financial accounts can be opened in scores of offshore, tax-free havens by professional asset managers protected by the virtually impenetrable veil of secrecy created by banking legislation and financial corporate policy.

We live in a world where it is both easy and acceptable to investigate, arrest and prosecute a $5.00 shoplifter while it is virtually impossible to investigate, arrest and prosecute a corporate thief or corrupt politician who obtains a ‘kick-back’ or embezzles or otherwise steals $5,000,000.00 from a corporation, business partner or spouse, particularly where cases involve multiple local or international jurisdictions.

It is all too convenient when information that is absolutely critical to the conduct of a civil or criminal investigation cannot be obtained because of ‘privacy’ considerations, when it is impossible to obtain Consent (from the uncooperative ‘person of interest’ or suspect) and it is equally impossible to obtain a Court Order because no one is in a position to advise the Court where – indeed in what country - or in what financial institution or other place the information or financial record that it is necessary to obtain may be found.

As far as my ‘Canadian Savvy’ is concerned, I would invite you to contact me directly at: 888-7XX XXX. As you know – or should know – our privacy interests in the United States, Canada and elsewhere have also been seriously eroded to the extent government and law enforcement have been given or assumed the ‘right’ to monitor e-mail and other communications for ostensibly legitimate as well as other arguably debatable reasons. It is simply unwise and foolhardy to retain let alone communicate anything of a sensitive personal or business nature in a file or via e-mail and/or attachments because the hard-drive or ‘brain’ of any computer simply contains and reflects the knowledge and thoughts of the person who uses or owns that computer and third-party monitoring or the deliberate ‘mirroring’ of a computer for criminal purposes or enforcement ‘fishing expeditions’ or investigations pose a very real threat except to the most innocuous users of this technology.
